Welcome to Actsfile
The mission of Actsfile is to empower people to build bridges, networks and partnerships for sustainable development in all communities.
Every living individual, contributes through his normal daily activities (Acts) or purposeful actions (Acts) to the development effort to transform the world. Sometimes one is not even aware of the importance of his actions! On Actsfile, you post your own Acts or the Acts of others, which may influence development in any field; such as the environment around you, strengthening family and friends, education, health, sports, entertainment, agriculture, etc. Your contributions are as important in fundamental areas such as your “personal development” and the “development of your community” (village, town, city, region, country, continent and the world). On Actsfile you have the opportunity to link the Acts you post to global development initiatives such as the Sustainable Development Goals (SDGs) of the United Nations, and Africa’s Agenda 2063 (The Africa we want) and more initiatives around the world.
Actsfile is a community of ordinary people, students, professionals, policy makers and decision makers working together as individuals and groups to create collaborations/partnerships to achieve the common goal of wealth generation to reduce poverty and promote sustainable development. For this reason, Actsfile is a dynamic platform for bringing people together to promote global initiatives such as the SDGs and continental agenda such as the “Africa we want” Agenda 2063. We present an opportunity to harmonize humanities effort to transform communities by building networks to promote global partnerships in line with SDG17 and previously, MDG8! Through the Actsfile, we shall launch initiatives, projects and programmes to make the world a better place.
Contract
The Actsfile User Agreement comprises the Actsfile Terms of Service (“Terms”), our Privacy Policy, the Actsfile Rules and all incorporated policies. By accessing the Actsfile Services (Services) including our website, widgets, advertisements (ads), Short Message Service (SMS), email notifications, and others, you accept these terms and conditions in full. When you access or use our services, as an individual, you agree to enter into a legally binding contract with Actsfile. By using our Services on behalf of a group, company, organization, government, or other legal entity, you confirm that you are authorized to do so on behalf of the entity and that the entity accepts this agreement.
The following terminology applies to these Terms, our Privacy Policy, the Actsfile Rules and all incorporated policies:
"Client", "You" and "Your" refers to you, the person accessing the Services and accepting the Actsfile terms and conditions.
"Client", "You" and "Your" also refers to a group, organization, government or legal entity that authorizes you to access the Services on its behalf.
"The Company", "Ourselves", "We", "Our" and "Us", refers to our Company (Actsfile co. Ltd.).
"Party", "Parties", or "Us", refers to both the Client and ourselves, or either the Client or ourselves.
The Service we Provide
Actsfile is about us (you and I), and how we impact our community and the world in which we live; and the universe around us. It is the little contributions that we make as individuals, groups, organizations, and governments and entities that add up to bring about the changes, progress, development and transformation that occurs in our nations around world.
What is an Act?
As an individual, you perform normal daily activities (Acts) and you interact with others for your personal, family or community advancement. Such activities may include purposeful actions to promote a particular cause; such as giving, encouragement, talks, meetings, volunteerism, entrepreneurship, sports business, etc.
Acts are simply the things that you or others do, your thoughts, ideas, and plans. Information we post on Actsfile therefore include our thoughts, words, sayings, advice, actions, interaction with others, and observations. Most times, people are not even aware that some of the simple things they do are important events.
It is the Acts of individuals, groups and organizations that collectively promote our “personal development” and the “development of your community” (village, town, city, region, country, continent and the world). By way of the things you think, do, say, and observe, you play a major role in shaping the future of your community and the world.
On Actsfile you have the opportunity to post your Acts in text format, or photos, videos, voice recordings, audio-uploads, file -uploads, smileys, GIF and others. The Acts you post are your own activities/ actions or the activities/actions of others that you consider important to either your personal growth and development or the growth and development of your community.
On Actsfile you also have the opportunity to link your Acts to global developmental initiatives such as the Sustainable Development Goals (SDGs) of the United Nations, and Africa’s Agenda 2063 (The Africa we want) and more initiatives around the world. Where you are not sure of the most appropriate development category to link your Act, you may involve the Actsfile community through online questions, chats and forums.
Actsfile also gives you the opportunity to acknowledge individuals, groups and organizations working with you as co-actors as well as those who help to finance your effort (your funding partners). Actsfile provides yet the opportunity to backdate your post to the actual date of an event that occurred in the past. This enables you to comfortably post past events and place them in clear historical context.
When you post an Act, you have the opportunity to add it to your biography and document your roles in development. Your biography provides an avenue to chronicle your Acts to tell the story of how you are helping to make the world a better place. Your biography, becomes your “living page”, testifying to your vision and purpose. Your experience on Actsfile will give you unparalleled satisfaction as a member of the human family who play their part in the infinite web of Acts that define progress, innovation, transformation and success in different aspects of human life and sustainable global development.
Who can access our Service
Actsfile is open to all categories of people with different cultural and religious backgrounds (low, middle- and high-income citizens; - poor and rich; - students and teachers; - researchers;- ordinary citizens and decision makers; - organizations, politicians and governments).
You may use Actsfile, if you are an adult as determined by the laws of your country.
You may not use Actsfile if you are bared by any laws or regulations prohibiting you from using such services.
Actsfile may be used by children of all ages provided they are enabled by a parent or legal guardian. If you are under 18, you must have your parent or legal guardian’s permission to use the Service. Your parent or legal guardian is obliged to read this Agreement with you. If you are a parent or legal guardian of a user under the age of 18, by allowing your child to use the Service, you are subject to the terms of this Agreement and responsible for your child’s activity on the Service.
Using the service (Rules)
These Terms regulate your access to and use of our Services, including any information, text, links, graphics, photos, audio, videos, Actsfile plugins, Actsfile related sites, learning, communication, apps or other materials or arrangements of materials uploaded, downloaded or appearing on the Services (Content). By using the Services, you agree to be bound by these Terms.
Actsfile is a community of all people, ordinary citizens, students, opinion leaders, professionals, government officials, policy makers and decision makers working together as individuals, groups and networks to achieve the common goal of wealth generation to reduce poverty and promote sustainable development. For this reason, Actsfile is a dynamic platform to promote initiatives such as the SDGs and Agenda 2063 “the Africa we want”. Actsfile present an opportunity to create Global Partnerships to mobilize humanities effort for transforming communities.
You may use Actsfile services only if you agree with the terms and conditions and all applicable laws, rules and regulations. Our services may change periodically, however the main concept and goal of Actsfile services will not be changed. In providing Actsfile services to users, we may change or stop providing certain features. We may also decide to terminate users, remove or refuse to distribute content on the services. We solely decide on the limits to usage and storage based on our discretion at any time.
In accordance to copyright and trademark laws you have the right to all content you post on or through our services. No compensation may be paid to you, although Actsfile or other recognized institutions or individuals, may make further use of the content, that you post, transmit or make available through our services. You give Actsfile permission and royalty-free license (with the right to sublicense) to use, reproduce, copy, process, adapt, modify, publish, display, transmit and distribute the content in any and all media known, not known or later developed. This license permits us to make your content available to the world and thus lets others do same. You hereby agree that this license gives us (Actsfile) the right to make content submitted to or through our services available to other institutions, organizations, companies or individuals for broadcast, distribution, promotion or publication of such Content on other media and you agree that Actsfile and its partners as well as it’s third-party providers may place advertisement on the service or in connection with the display of content from the services whether posted by you or other users. Because you own your content and information and we only have non-exclusive rights to it, you may choose to make it available to others, including under the terms of a Creative Commons license.
In using Actsfile services, do not do any of the following:
a) Create a false identity on Actsfile, or, use a misleading profile. On Actsfile, you must use your real name;
b) apart from the available interfaces provided by Actsfile, do not use any other method or tools to access or search Actsfile services. You need permission (separate agreement) from Actsfile management to do otherwise; access or tamper with the non-public areas of the Actsfile platform, computer systems, or the technical delivery systems;
c) use the Actsfile services to send altered, deceptive or fraudulent source-identifying information;
d) scan or test for vulnerability of the Actsfile system or try to circumvent the security and authentication system
e) interfere or disrupt, the Actsfile system by engaging in activities not limited to sending a virus, overloading, flooding, spamming, mail-bombing the services;
f) disclose confidential information of others, individuals, groups or organizations without their permission;
g) violate the intellectual property rights (copyrights, patents, trademarks, trade secrets and other proprietary rights) of others;
h) copy or distribute posts or other content to others (except sharing through the available Actsfile services). To share otherwise, you need the permission of the IP owners which they may give by posting under a Creative Commons license;
i) remove Actsfile name or logo from any information such as, text, video or audio or others;
j) post viruses, worms or any other harmful software code;
k) engage in renting, leasing, loaning, trading, sell/re-selling or monetize the Services or related data, without Actsfile’s consent;
l) overlay or otherwise modify the Services or their appearance (such as by inserting elements into the Services or removing, covering, or obscuring an advertisement included on the Services);
m) interfere with the operation of, or place an unreasonable load on, the Services (e.g., spam, denial of service attack, viruses, gaming algorithms); and/or
Actsfile reserves the right to access, store, use and disclose any information we consider necessary for the following:
(i) compliance with applicable state laws, regulations and legal process,
(ii) investigate potential violations of the Terms,
(iii) address fraud by means of detection, prevention, and promotion of security and technical measures,
(iv) respond to requests by users for support,
(v) Ensure safety and protect the rights and property of Actsfile and its users, and the public.
Except as indicated in Actsfile Privacy Policy, we do not disclose personally-identifying information to third parties.
Actsfile requires that you disclose your identity including your actual name, for the purposes of building trust, recognition and awards. Your true identity is also needed for our vision of real people contributing to shape the future of the world.
Content on the Services
Actsfile may help connect Members interested in various aspects of development and sharing their projects and experiences on Actsfile Services. Members seeking to share information, experiences, inspire and support others may link up and assist one another. However, you must be at least 18 years of age to offer, perform or procure services. You accept that Actsfile does not supervise, direct, control or monitor Members in the performance of these services and agree that, Actsfile is not responsible for the offering, performance or procurement of these services, however, Actsfile may endorse a particular Member’s offered services or that of our partners or Affiliates. Under such circumstances, Actsfile will sign special contractual agreements with any Member, partners or Affiliates offering services to create an employment, agency, or joint venture relationship. If you are a Member offering services, you represent and warrant that you have all the required licenses and will provide services consistent with these terms and conditions.
Similarly, Actsfile may endorse a particular event listed on our Services help you register for and/or attend events organized by Members, partners and Affiliates, and connect with other Members who are attendees at such events. You agree that Actsfile is not responsible for the conduct of any Member or other attendees at such events. However, unless otherwise indicated, Actsfile does not review and/or vet any of these events, and you adhere to these terms and conditions that apply to such events.
On Actsfile services you may encounter links to third-party websites and online services that are not owned or controlled by us. Actsfile assumes no responsibility for, such websites and online services. Be aware when you leave the Actsfile Service. We recommend that you read the terms and privacy policy of each third-party website and online service that you visit.
• You are responsible for the content you provide on Actsfile services.
• On Actsfile service you may post any information you consider appropriate that you are comfortable to share with others. However, any content you post or obtain through our services is at your own risk.
• The content you and others post in using our services may not be monitored and we cannot take responsibility for your content. In using Actsfile services, you may come across inaccurate, delayed, misleading, deceptive, inappropriate or offensive information.
• Unlawful conduct, harassment and impersonation is not allowed on Actsfile services. User posts should not violate copyright and trademark, laws. To appeal violations or make specific reporting you may contact https://support.actsfile.com
• Kindly visit, fill and submit copyright reporting forms at https://support.actsfile.com if your content has been used or copied in any way that violates copyright laws.
• By accepting these terms and conditions, you promise that you have obtained all rights, licenses, consents, permissions, power and/or authority necessary to grant the rights granted herein for any content that you post or display on or through the services.
• You may use Actsfile Content to promote your initiative. However, Actsfile reserves all of its intellectual property rights in the Services. Trademarks and logos used in connection with the Services are the trademarks of their respective owners. Actsfile, logos and trademarks, service marks and graphics used for our Services are trademarks or registered trademarks of Actsfile.
You and Actsfile agree that if content includes personal data, it is subject to our Privacy Policy.
Changes to the service and Account Suspension and Termination
Actsfile services will show information and content you or others post. However, we do not promise to keep showing your posts indefinitely. We are not obliged to store and provide copies of your posts and content, except required by the law as indicated in Actsfile privacy Policy. We shall change or end any aspect of the service and we may suspend or discontinue Services.
You may stop using Actsfile Service at any time. Your access may also be suspended or terminated by Actsfile for reasons such as, repeated breach of this Agreement; Service changes; need to comply with a legal requirement or a court order; or our reasonable belief that there has been conduct that creates liability or harm to any user, other third party, Actsfile or our Affiliates.
Actsfile may remove any Content if it reasonably believes that it is in breach of this Agreement or may cause harm to our users, or third parties, we may remove or take down some or all of such Content. Actsfile may notify you with the reason for termination or suspension unless by doing so we would violate the law or compromise an investigation or the integrity or operation of the Service; or would cause harm to any user, other third party, Actsfile or our Affiliates.
Actsfile may modify this Agreement occasionally to reflect changes to our Service or for legal, regulatory, or security reasons.
The licence you grant continue until your Content is removed from the services except where the use of Content was permitted before removal or the law requires otherwise. Removal of Content by you does not require Actsfile to: recall Content that is being used by other users within any limited offline viewing functionality of the Service; or delete copies we reasonably need to keep for legal purposes.
If you fail to comply with this Agreement and we do not act immediately, it doesn’t mean that we are giving up any rights that we may have (such as the right to take action in the future). If it turns out that a particular term of this Agreement is not enforceable for any reason, this will not affect any other terms.
Actsfile may transfer all or part of this Agreement to an Affiliate or, if Actsfile is sold, to a third party.
Automated Processing
We use data and information about you to make relevant suggestions to you and others.
We use the information and data that you provide and that we have about Members to make recommendations for connections, content and features that may be useful to you. For example, we use data and information about you to recommend development partners and jobs to you and you to recruiters or contractors. Keeping your profile accurate and up to date helps us to make these recommendations more accurate and relevant.
Basis of the Bargain; Exclusions
The limitations of liability in this Section are part of the basis of the bargain between you and Actsfile and shall apply to all claims of liability (e.g., warranty, tort, negligence, contract and law) even if Actsfile or its affiliates has been told of the possibility of any such damage, and even if these remedies fail their essential purpose.
These limitations of liability do not apply to liability for death or personal injury or for fraud, gross negligence or intentional misconduct, or in cases of negligence where a material obligation has been breached, a material obligation being such which forms a prerequisite to our delivery of services and on which you may reasonably rely, but only to the extent that the damages were directly caused by the breach and were foreseeable upon conclusion of this Contract and to the extent that they are typical in the context of this Contract.
Governing Law and Dispute Resolution
In the unlikely event we end up in a legal dispute, you and Actsfile agree to resolve it in Ghana courts using Ghanaian law.
This section shall not deprive you of any mandatory consumer protections under the law of the country to which we direct Services to you, where you have your habitual residence. If you live in the Designated Countries: You and Actsfile agree that the laws of Ghana, shall exclusively govern any dispute relating to this Contract and/or the Services. You and Actsfile agree that claims and disputes can be litigated only in Accra, Ghana, and we each agree to personal jurisdiction of the courts located in Accra, Ghana.
You may not assign or transfer this Contract (or your membership or use of Services) to anyone without our consent. However, you agree that Actsfile may assign this Contract to its affiliates or a party that buys it without your consent. There are no third-party beneficiaries to this Contract.
You agree that the only way to provide us legal notice is at the addresses provided here.
Complaints Regarding Content
We respect the intellectual property rights of others. We require that information posted by Members be accurate and not in violation of the intellectual property rights or other rights of third parties. We provide a policy and process for complaints concerning content posted by our Members.
